While I hate to hear that someone died. I'm sure that theft won't be too much of an issue in that neighborhood for a while.

If you have a shotgun, maybe a beanbag round would be just as effective? If you're a thief you definetely wouldn't want to die but also, the posibility of a beanbag round traveling at 300 ft/sec hitting you square in the back may also be enough of a deterent to avoid the same neighborhood. Two rounds wouldn't hurt either. And as a "just in case", round #3 and #4 could be some 00 buck shot.

With that said, I don't like the idea of using less than leathal force against criminals. Dead men tell no tales (in a court of law). But it does seem deadly force may be a bit much for someone breaking into your car. I've had someone break into my wive's car outside our window. We didn't catch the thief and there was nothing of value to steal inside but had I caught them, I don't think I would of pulled the trigger unless they reached for something that I thought might harm me.

Personally, I would never load a beanbag but that's just me. Like you said, dead men tell no tales.....they don't come looking for revenge either. Would I put someone in the ground in CA for breaking into my car? Probably not, simply because I have a family who depends on me and it would be hard to support them from jail. Would I put them down in TX? Absolutely. I've worked too hard for the stuff I own and I intend on keeping it. Hell, if I were in TX and saw the thief a week later holding my stuff I would have every right to shoot to kill.

Maybe I'm a bit too far on this one but I think criminals tend to get too many rights nowadays.


Or maybe it's just winter so I have time to think about this kind of crap.

I agree it is legal under Texas Law, just don't agree that deadly force should be authorized for that unless the person is afraid for their own life like in a car jacking. Lady probably shot the kid in the back too.

Facts: The lady saw someone breaking in to her car ("...reasonably believes"). It was 9PM ("theft at night"). Car was being stolen ("escaping with property"), and the owner is a pregnant female ("....expose the actor or another to a substantial risk of death or serious bodily injury.")

Yep. From what little I know, it sounds kosher to me, under TEXAS law.

Seems kind of moot arguing the validity of another state's laws, given the fact that the citizens of that state democratically voted in the legislature that enacted the statute.

This same statute, in California, plus lobster season: lot of dead people.

Realy , Isn't Texas the state where the asian guy was shot dead for knocking on the wrong door by mistake ?? I guess if your the right ilk your good in Texas but if your not , your fair game. Been to texas and the people where cool as hell and it was nice to have everyone wave and say hi as the passed but half the people I see where ever I travel shouldn't be able to drive a car non the less own a gun and make a decison on who lives or dies.

Ilk= same family, class or kind ?? By the way so what family class or kind lives in Texas and not elseware ?

First of all if I had a job there I'm off. Second everbody f's different. Texas and California are just different not better not worse just different. It's more about a lifestyle thing. If this story was about Iraq or some Arab state it would talk about cutting off hands. Shit happens because we let it. Texas is just a little more direct in their approach.
